If every day my neighbor threw his coffee cup with his name on it in my bushes along the public sidewalk in front of my house I could sue him and prevail.
But if my neighbor sold coffee in mugs with my neighbor's name on the mug, and the the mug ended up everyday in my bushes along the public sidewalk in front of my house I couldn't sue him and prevail.
That's a huge loop hole every manufacturer and seller of commercial beverages leverages to the max.
